Acceptable Use Policy

Ragged Edge Community Network (“RECN”) Acceptable Use Policy (“AUP”) is intended to help enhance the use of the Internet by preventing unacceptable use. All users of RECN’s Internet services (the “Services”), those who access some of our Services but do not have accounts (“Visitors”), as well as those who pay a monthly service fee to subscribe to the Services (“Customers”), must comply with this AUP.

RECN reserves the right to revise this Agreement at any time. You are responsible for regularly reviewing information posted online to obtain timely notice of such changes or revisions. Continued use of RECN services constitutes your acceptance of this agreement.

Illegal and Inappropriate Activity:

Using the “services” to transmit any material (by email, uploading, posting, or otherwise) that, intentionally or unintentionally, violates any applicable local, provincial, national or international law, or any rules or regulations is a violation of this AUP agreement. This includes:

  • Harm to minors. Using the Services to harm, or attempt to harm, minors in any way.

  • Threats. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that threatens or encourages bodily harm or destruction of property.

  • Harassment. Using the Services to transmit any material (by email, uploading, posting, or otherwise) that harasses another.

  • Fraudulent activity. Using the Services to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as “pyramid schemes,” “Ponzi schemes,” and “chain letters.”

  • Forgery or impersonation. Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited.

  • Unsolicited commercial email/Unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature, are prohibited.

  • Unauthorized access. Using the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Illegal use. Using the Copyright or trademark infringement.

  • Collection of personal data. Using the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent.

  • Reselling the services. Reselling the Services without RECNS authorization.

  • Network disruptions and unfriendly activity. Using the Services for any activity, which adversely affects the ability of other people or systems to use Ragged Edge Community Network’s Services or the Internet. This includes “denial of service” (DoS) attacks against another network host or individual user.

  • News. Customers should use their best judgment when posting to any newsgroup. Many groups have charters, published guidelines, FAQs, or “community standards” describing what is and is not considered appropriate.

  • Long Connections and Multiple Logins. Using a personal account for high volume or commercial use is prohibited. The Services are intended for periodic, active use of email, newsgroups, file transfers, Internet chat, games, and browsing the World Wide Web.

  • Exceeding Web Site Size and Traffic Limitations: All RECN Customers receive free web space for use with their RECN Internet access account. Each customer’s free web space is allocated a certain amount of traffic per month (traffic is calculated on a formula multiplying the number of hits that your site receives by the size of your files). If a site exceeds its maximum monthly allotment of traffic, the site will become unavailable until the beginning of the next calendar month.

  • Customers exceeding their GB package they have subscribed to (upload and download limit) within a calendar month, will be charged $2.95 per GB plus applicable taxes, over their GB limit.

SECURITY

You are responsible for any misuse of the Services that originate from your account, even activities committed by any friend, family, co-worker, employee, guest or anyone with access to the account. You must ensure that others not gain unauthorized access to the Services.

The Services may not be used to breach the security of another user, or to attempt access to anyone’s computer, software or data, without the knowledge and consent of that person. The Services may not be used in any attempt to circumvent the user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, probing the security of other networks.

RECN reserves the right to investigate suspected violations of this Agreement, including the gathering of information from you or other users involved and the complaining party, if any, and examination of material on RECN servers and network. During an investigation, RECN may suspend the account or accounts involved and/or remove material which potentially violates this Agreement.

You hereby authorize RECN to cooperate with (i) law enforcement authorities in the investigation of suspected criminal violations, and/or (ii) system administrators at other Internet service providers or other network or computing facilities in order to enforce this Agreement. Such cooperation may include RECN providing the username, IP address, or other identifying information about a subscriber, in accordance with the guidelines set out in RECN Privacy Policy.

Upon termination of your account, RECN is authorized to delete any files, programs, data and email messages associated with such account.

You agree that RECN has the right to remove all subscriber equipment including the modems, power supplies and cabling, if service has been terminated for any reason. This subscriber equipment is on-loan from RECN as it is needed to connect your computer to the network. Subscriber equipment remains the property of RECN. You agree not to sell, transfer, lease, assign any interest in, or encumber all or any part of the RAGGED EDGE COMMUNITY NETWORK-owned high-speed equipment. You are responsible for maintaining equipment in a secure location, preventing damage to the equipment and returning the equipment when the service is terminated. If equipment is not returned or is returned damaged, you are responsible for replacement costs, which range between $400 and $700 depending on the subscriber equipment used.

The failure of RECN to enforce this Agreement, for whatever reason, shall not be construed as a waiver of any right to do so at any time.

You agree that, if any portion of this Agreement is held invalid or unenforceable, that portion will be construed consistent with applicable laws as nearly as possible, and the remaining portions will remain in full force and effect.
